• Description:
• Tenders are invited for Consultancy Agreement to Provide Legal Services (Lawyer). Under the project of emergency medical assistance for host and displaced population affected by the current crisis in Yemen funded by GFFO3. Médecins du Monde intends to award consultancy agreement to provide legal services. The requirements of selecting a legal firm are as follow: Provide legal advice and consultation to MdM- France in Yemen on all legal issues related to the organization, including but not limited to: Providing legal advice in relation to the organization's bylaws and regulations, including the disciplinary regulations and their degree of conformity with Yemeni laws and regulations. Providing legal advice and reviewing work contracts of all kinds concluded between the organization and its employees, as well as providing legal advice regarding the termination of work contracts and all consultations related to the relationship between the employee and the organization in accordance with the Yemeni labor law (providing a written legal opinion upon request). Legally reviewing and approving contracts and agreements concluded with suppliers, customers and service providers, as well as memoranda of understanding and sub-agreements, and alerting the organization to any legal consequences that the organization may bear based on those contracts or agreements. Providing advice and representing the organization (if required) and responding to communications from government agencies, especially with regard to the income tax law, the social insurance law and any type of tax audit. Follow up on the payment of income tax dues, as well as social insurance contributions to the concerned authorities. Follow up on partners of the organization such as government agencies as well as civil society organizations (CSOs) that are falling behind in the fulfillment and performance of their obligations; This should be done in a friendly manner and in accordance with the organization's referral of any issue or issue to the Service Provider; Take the necessary legal measures against the partners of the organization who violate any terms or conditions of a contract/ agreement concluded between the organization and its partners in accordance with a request submitted by the organization in this regard. In the event that the matter between the organization and the partner reaches court, the parties must conclude a separate agreement. The Service Provider participates with the Organization upon request in negotiations with third parties to achieve the best conditions for the Organization. Provide legal guidance and ensure compliance with rules and regulations. Structuring, drafting and reviewing reports and other legal documents. Representing the organization in legal proceedings (administrative boards, trials, etc.) The criteria of selecting a legal firm are as follow: 1- Possess Tax Card, Commercial Registration, and License (Law Practice License). 2- Relevant years of experience in topics such as labor law, tax law, social security law, can win cases or solve disputes. 3- Relevant long experience in legal advisory with INGOs. 4- Strong analytical, research skills, and effective interpersonal and communication skills. Application Requirements: 1- RFQ. 2- The RFQ and company profile must be submitted to Sana-a MdM office (Contact Number: 711203073), not later than 10 March 2022. 3- The RFQ and Company profile must be submitted in sealed envelopes and indicate the reference number and request Subject in the envelope cover. Any request for clarification must be received by MDM (Médecins du Monde) in writing to procurement.yemen@medecinsdumonde.net at least 5 days before the deadline for submission of tenders. MDM will reply to bidders' questions at least 2 days before the deadline for submission of tenders.
